LOTTO MAX UP CLOSE “MARQUEE CONCERT” CONTEST

The LOTTO MAX UP CLOSE “Marquee Concert” contest (the "Contest") is sponsored by the Ontario Lottery and Gaming Corporation ("OLG") and is organized and administered by Universal Music Canada Inc. ("UMC") and its division, Shed Creative Agency (the "Contest Organizer").

The Contest commences on Wednesday August 7, 2019 and ends on Wednesday September 18, 2019 at 11:59:59 pm. For the purposes of these Official Rules and Regulations all times and dates refer to Eastern Time ("ET").

Participation in the Contest constitutes full and unconditional agreement and acceptance of these Official Rules and Regulations (the "Contest Rules"), which are binding on all matters relating to the Contest.

1. Eligibility:

No Purchase Necessary. The Contest begins on August 7, 2019 and closes at 11:59:59 p.m. ET on September 18, 2019 (the "Contest Closing Date") (collectively, the "Contest Period").

This Contest is open only to legal residents of Ontario who are 18 years of age or older. Notwithstanding the foregoing, the Contest is not open to: employees and volunteers (and their immediate families and those with whom they are domiciled) of UMC, OLG, the Alcohol and Gaming Commission of Ontario, and each of their respective subsidiaries, affiliates, directors, officers, governors, agents, their advertising and promotional agencies. Immediate family includes the husband, wife, son, daughter, brother, sister, mother, or father of an individual.

2. PRIZES AND CHANCES OF WINNING:

  1. There are two categories of prizes available to be won: (a) one hundred and ninety (190) Marquee Prizes and (b) ten (10) VIP Prizes (collectively the "Marquee Prizes"), as outlined in Rule 4a and Rule 4b below.
  2. The odds of winning a Marquee Prize depend on the total number of all entries (regardless of the method of entry) received during the Contest Period.
  3. Entrants are limited to winning one (1) Marquee Prize or one (1) VIP Prize.

3. How To Enter:

  1. First Time Online Entry: Anytime during the Contest Period, visit www.lottomaxupclose.ca, or www.lottomaxupclose.com and follow the Contest link to the LOTTO MAX UP CLOSE “MARQUEE CONCERT” contest and fully complete and submit the online entry form.
  2. In order to be eligible to participate in the Contest, entries must be received during the Contest Period. Only entries received in accordance with these Contest Rules will be accepted. No purchase necessary. No other methods of entry will be accepted.
  3. Any personal information collected by OLG and/or the Contest Organizer is collected pursuant to the Ontario Lottery and Gaming Corporation Act, 1999 and is intended to be used for the following principal purposes: to conduct and administer the contest by OLG and/or the Contest Organizer, including but not limited to the awarding of the Marquee Prize or Marquee Meet & Greet Prize, and to comply with legal requirements. Where you have provided your consent, OLG may then provide you with the information or services you have opted in to receive. In addition, without limiting the generality of the foregoing, if you are confirmed as a prize winner, you consent that your photo, name, and residence (town or city only) may be posted, published, or announced on by OLG on the OLG website and/or other media for up to 12 months after being confirmed as a winner.   4. Except where prohibited, participation in the Contest constitutes consent to the use of a contestant’s or winner’s or Up Close Concert Friend’s name, likeness, voice, opinions and biographical information for publicity, advertising, trade or promotional purposes in any media or manner, now known or hereafter devised, worldwide, without further payment, consideration, notice or approval.
  5. All entries will become the property of the Contest Organizer and OLG and will not be returned. Entries which are incomplete or fraudulent are null and void. Multiple entries using the same email account or using any device to play multiple times or as multiple contestants will result in disqualification. All entries must be submitted from a valid e-mail account that may be identified by reverse domain name search. In the event of a dispute as to entries submitted by multiple users having the same e-mail account, the authorized subscriber of the e-mail account used to enter the Contest at the actual time of registration will be deemed to be the participant and must comply with these Contest Rules; the unauthorized subscriber(s) will be disqualified. An authorized account subscriber is deemed to be the natural person who is assigned an e-mail address by an Internet access provider, online service provider or other organization, which is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The potential winner may be required to provide the Contest Organizer and/or OLG with government issued ID and proof that the potential winner is the authorized account holder of the e-mail address associated with the potential winning entry. By entering the Contest, you agree to be bound by the decisions of the Contest Organizer and/or OLG, which are final with respect to all matters relating to the Contest. The Contest Organizer and OLG accept no responsibility for entries which are lost, misdirected or delayed for any reason. Nor is any responsibility assumed for incorrect or inaccurate capture of entry information, including (but not limited to), malfunction, human error, lost/delayed/garbled Internet/e-mail transmission, omission, interruption, deletion, defect, or failures of any telephone, technical, network, online, or hardware or software or any combination hereof.

4. Prizes:

The following prizes are available to be won:

  1. Marquee Prizes

    There are a total of one hundred and ninety (190) Marquee Prizes available to be won in this Contest.

    Each Marquee Prize consists of:
    Two (2) General Admission floor tickets to see the LOTTO MAX UP CLOSE Marquee Show (Alessia Cara) at the Mod Club ("Marquee Venue") on October 2nd, 2019. Winners must arrive at the Marquee Venue by 8:00 pm ET for guaranteed entry. In the event that a Winner does not arrive at the Marquee Venue by 8:00 pm ET, the Contest Organizer may refuse entry of such Winner and allow another person, whether or not a contest entrant, to enter instead. In such an instance, Contest Organizer may (in its sole discretion) provide Winner with a substitute prize of Contest Organizer’s choosing.

  2. VIP Prizes

    There are a total of ten (10) VIP Prizes available to be won in this Contest.

    Each VIP Prize consists of:
    Two (2) Meet & Greet with Alessia Cara and VIP tickets to see the Lotto Max Up Close Marquee Show at the Mod Club on October 2nd, 2019. Winners must arrive and check in with Contest Organizers by 7:00 pm ET at the Marquee Venue in order to guarantee their participation in the Meet & Greet and any other pre-concert activities that may be extended to Winners.

  3. Each Prize winner and guest must be 18 years of age or older. In all cases, the Contest Organizer and/or OLG reserve the right to request proof from the Marquee Prize or the Marquee Meet & Greet Prize winner and guests of their respective identity, age and residency, as applicable. Approximate retail value of each Marquee Prize is four hundred dollars ($400.00 CDN). Approximate retail value of each VIP Prize is six hundred dollars ($600.00 CDN). There are no substitutions of any prize except at the sole and unfettered discretion of OLG or the Contest Organizer.
  4. All incidental costs and personal expenses not specifically identified as being included in the Marquee Prizes or VIP including (without limitation) transportation from winner’s residence to and from event locations ("Marquee Venue") meals, beverages, alcoholic beverages, insurance, entertainment and items of a personal nature, or any other expenses not specifically mentioned shall be the sole responsibility of each winner and their guest. Winner may bring one (1) guest that must be 18 years of age or older at time of event and that same guest must complete all prizing elements with winner. Transportation will not be provided for the winner or guest to The Marquee Venue.
  5. Marquee Prize winners, VIP Prize winners and guests must follow all directions of the Contest Organizer and/or OLG. Failure to do so may result in termination of their participation, or continued participation, in the Marquee Prize or VIP Prize, as applicable.

5. Draw/Winner Selection:

  1. Marquee Prize & VIP Draw: A total of one hundred and ninety (190) Marquee Prize winners and ten (10) VIP Prize winners will be selected at the conclusion of the contest period at SHED Creative Agency, 473 Adelaide St. Toronto Ontario, M5V 1T1 (or such other address as Contest Organizers may designate) on or around September 19, 2019. Chances of winning a Marquee Prize depends on the number of eligible entries received in the Contest Period by the Contest Closing Date. The ten (10) VIP Prizes will be drawn first, then the one hundred and ninety (190) Marquee Prizes.
  2. Eligible Marquee Prize winners will be notified by either telephone or email at such telephone number/email address as provided on the Contest entry form.
  3. Before being declared a prize winner, all selected entrants must: (i) correctly answer a time-limited mathematical skill-testing question without assistance or the use of a calculator, administered by email at the time of contact; (ii) sign an audio visual release which allows the Sponsors to record, broadcast, and exploit the selected entrant’s image, voice, and likeness in any and all media as it deems appropriate; and (iii) the selected entrant and his/her guests must sign a Declaration of Compliance with the Contest Rules and a Release of Liability (the releases listed in (ii) and (iii) together the "Declaration and Release Documents"), releasing the Contest Organizer and OLG and each of their respective subsidiaries, affiliates, directors, officers, governors, agents (collectively, the "Released Parties") from any and all liability in connection with: (i) their participation in the Contest; (ii) the acceptance and use of any prizes awarded in connection with the Contest; and (iii) the administration of the Contest by the Contest Organizer, including (without limitation) the selection of prize winners or the distribution of prizes awarded in this Contest. The Declaration and Release documents must be signed and returned on or before the date indicated on the documents or the applicable prize will be forfeited.
  4. If a selected entrant cannot answer, or incorrectly answers, the skill-testing question, or fails to respond to the notification within forty-eight (48) hours of the first attempted contact, or if UMC is otherwise unable to contact the selected entrant within such time, or if the selected entrant fails to return the executed Declaration and Release document within the time specified by the Contest Organizer, or if a selected entrant otherwise does not meet any of the Contest eligibility requirements, or does not accept his/her prize, or satisfy any other Contest conditions, that entry will be disqualified and another entry may be selected via random draw from all remaining eligible entries.
  5. Without limiting the generality of the foregoing, OLG reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law.
  6. By entering the Contest, entrants agree to hold harmless and indemnify the Released Parties against any and all liability, damages or causes of action (however named or described with respect to or arising out of either: (i) their participation in the Contest; (ii) the receipt, use of or participation in the prizes awarded herein; or (iii) the administration of the Contest (including winner selection) and distribution of the prizes awarded herein. Furthermore, entrants hereby release, waive and discharge any and all claims of damage, loss or causes of action (including, negligence), including (but not limited to) death, personal injury or loss or damage to property, which the entrant or any of the entrant’s representatives, heirs, next of kin or assignees ("Entrant’s Representatives") may have or which may hereinafter accrue to the entrant or Entrant’s Representatives against the Released Parties as a result of the entrant’s participation in the Contest or the receipt or use of a prize awarded herein.

6. General Rules

  1. Each prize must be accepted as awarded and no prize substitutions of cash or otherwise or transfer of the prize will be made, provided that the Contest Organizer and OLG may make prize substitutions of equal or greater value, at their sole discretion. No telephone contact or correspondence will be entered into except with potential prize winners. Unclaimed prizes will not be awarded.
  2. All participants must present valid government-issued photo identification upon request.

    Concert Organizer and OLG may make any changes to the Marquee Prizes including but not limited to concert day, time, or location up to and including the day of the performance due to any unforeseen circumstances.
  3. By entering this Contest, each entrant consents to the use of his/her name, image, photograph, video, voice statement(s) and city of residence by the Contest Organizer and OLG without further compensation, for any and all publicity purposes, commercial or otherwise, in all media. The Contest is subject to all applicable federal, provincial and municipal laws and regulations and shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
  4. By entering the Contest, each entrant agrees to be bound by these Contest Rules and all decisions of the Contest Organizer and OLG, whose decisions are final with respect to all matters relating to the Contest, including (without limitation) the selection of prize winners. All decisions made by the Contest judges with respect to any aspect of this Contest are final.
  5. The following are prohibited and will result in automatic disqualification from the Contest: (1) using any method that artificially increases chances of winning; (2) non-compliance with these Contest Rules; and (3) any other act which the Contest Organizer and OLG determine, at their sole discretion, jeopardizes the integrity of the Contest.
  6. The Contest Organizer and OLG may terminate, modify, suspend, or withdraw from this Contest (and/or any aspect thereof, including methods for selection of the prize winners), in whole or in part, at any time without notice for any reason, without liability, at their sole discretion, including, without limitation the delay or cancellation of the Contest performance – on the October event date in question or, if viruses, bugs, tampering, or other causes beyond the Contest Organizer’s and OLG’s control affect the security, fairness or proper play or conduct of the Contest. In the event a substitute prize is awarded, such prize must be accepted as awarded and cannot be exchanged for cash or other means. Further, the Contest Organizer and OLG reserve the right to disqualify any person and void any entries of that person who it believes has tampered with the entry process or any other component of the Contest, whose conduct or action affects the administration, security or fairness, integrity or proper conduct of the Contest or who fails to meet or abide by these Contest Rules.
  7. The Contest Organizer and OLG shall not be responsible for tampering, theft, human errors (including gross negligence) ineligibility, lost, late or misdirected entries or for any problems, failures or technical malfunctions of any telephone network or lines, computer online systems or servers, computer software problems or traffic congestion on the internet, or at any website and assume no liability for damage to entrant’s or any person’s computer resulting from participating in the Contest. Online entries must be submitted from a valid e-mail account that may be identified by reverse domain name search.
  8. The LOTTO MAX UP CLOSE promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram.
  9. The LOTTO MAX UP CLOSE promotion is in no way sponsored, endorsed or administered by, or associated with, Twitter.
  10. The LOTTO MAX UP CLOSE promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook.
  11. The LOTTO MAX UP CLOSE promotion is in no way sponsored, endorsed or administered by, or associated with, Google.
  12. All references to times and dates reflect Eastern Standard Time.
    LOTTO MAX is not associated with, sponsored by, authorized or endorsed by the to be announced performer or UMC in any way.
  13. Any personal information provided to or collected by OLG, including but not limited to participants’ contact information, is collected pursuant to the Ontario Lottery and Gaming Corporation Act, 1999 and is intended to be used for the following principal purposes: to conduct and administer the Promotion by OLG, including but not limited to the awarding of the gifts/prizes, and to comply with legal requirements.   14. OLG reserves the right to change or alter this Promotion, as it deems appropriate, including making changes or alterations to these Rules and Regulations in order to accommodate participants in accordance with the Accessibility for Ontarians with Disabilities Act, 2005 (AODA).
